The legal requirements for Energy Performance Certificates (EPCs) in the UK are governed by regulations aimed at improving energy efficiency in buildings. Below is an outline of the key legal obligations and requirements:


Governing Legislation

  • Energy Performance of Buildings (England and Wales) Regulations 2012 (amended): Requires EPCs for property transactions.
  • Minimum Energy Efficiency Standards (MEES) Regulations: Enforces minimum EPC ratings for rented properties in England and Wales.
  • Equivalent Regulations in Scotland and Northern Ireland:
  • Scotland: Governed by the Energy Performance of Buildings (Scotland) Regulations 2008.
  • Northern Ireland: Governed by the Energy Performance of Buildings (Certificates and Inspections) Regulations (Northern Ireland) 2008.


When EPCs Are Legally Required

  • Selling a Property: The seller must provide an EPC to potential buyers when marketing the property.
  • It must be available before any written sales agreement.
  • Renting Out a Property: Landlords must provide an EPC to prospective tenants before signing a tenancy agreement.
  • Applies to new tenancies and lease renewals.
  • Constructing a New Building: Developers must obtain an EPC upon the building's completion.
  • The certificate must be based on the building's design and construction materials.
  • Public Buildings: Public buildings over 250m², frequently visited by the public, must display a Display Energy Certificate (DEC) in a prominent location.


Minimum Energy Efficiency Standards (MEES)

Residential and Commercial Rentals:

  • Properties in England and Wales must have an EPC rating of E or above to be legally rented.
  • Applies to new leases since April 2018 and existing leases since April 2020.


Penalties for Non-Compliance:

  • Residential Properties: Fines of up to £5,000.
  • Commercial Properties: Fines can reach £150,000, depending on the rateable value and duration of non-compliance.


Exemptions:

Properties listed on the EPC Exemptions Register, 

such as:

  • Properties where required improvements would negatively impact their historic character (e.g., listed buildings).
  • Properties where all possible energy efficiency improvements have been made, but the rating remains below E.ower energy bills and increase property comfort.
